TERMS & CONDITIONS
1. It is understood that Nauseen Taher is the exclusive, official photographer retained to perform the photographic services requested on this Contract.
2. The Photographer may substitute another photographer to take the photographs in the event of her illness or unforseeable conflicts in scheduling. In the event of such substitution, Nauseen Taher Photography warrants that the photographer taking the photographs shall be a competent professional.
3. Session fees must be paid on or before the portrait session date. Images will not be available until the session fee has been paid in full. Images will be delivered 3-6 weeks after the session date via an online gallery.
4. No part of any order, including digital images, will be delivered until the order balance has been paid in full. Editing will not start until the balance has been cleared. Your session is queued up for editing and gets pushed down until the balance is cleared. Therefore delivery is not guaranteed within the promised time frame if you delay the final balance.
5. Negatives digital files and previews remain the exclusive property of Nauseen Taher Photography. No Raw will be available for purchase. All photos delivered will be edited in the signature style displayed in the portfolio.
7. Upon signature, the Photographer shall reserve the time and date agreed upon.
8a. Rescheduling/ Late Arrivals for full session. In the event that the Client requests to reschedule a session, the retainer shall be applied to a new session if notice is given at least 3 days prior to the scheduled event. The reschedule must be within the same calendar year. Reschedules can be made for emergencies, weather, sickness, and unforeseen circumstances. Late arrivals will be treated on a case by case basis. Late arrivals will have the time deducted from their session slot if no time is available. All retainer paid are non-refundable, even if the portrait is rescheduled or canceled for any reason other than Act of God.
8b. Special Mini Promotional Sessions (No Rescheduling)
Special mini promotional sessions, including but not limited to themed days, limited-time offers, or discounted mini sessions, are offered on fixed dates and times only. Once a mini session is booked, it cannot be rescheduled, moved, swapped, or transferred to another date or time under any circumstances, including but not limited to sickness, emergencies, weather conditions, or unforeseen events.
All retainers and payments made for mini promotional sessions are strictly non-refundable and non-transferable. Failure to attend the scheduled session or late arrival will result in forfeiture of the session without refund or credit
9. If, in the opinion of the Photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards Nauseen Taher Photography , the Photographer may elect to use an alternate location or to reschedule the session.
10. If Nauseen Taher Photography cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer ’s illness or emergency, then the Photographer shall return any monies paid to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event that Nauseen Taher Photography fails to perform for any other reason, Nauseen Taher Photography shall not be liable for any amount in excess of the retail value of the Client’s order.
11. The Client is responisible for protecting and caring for his/her printed and/or digital products Nauseen Taher Photography is not responsible for any damaged products after successful delivery of said products.
12. The charges in this Contract are based on Nauseen Taher Photography ’s Standard Price List as displayed on the website. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
13. NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce negatives, digital images and printed photographs elsewhere without Nauseen Taher Photography ’s permission, in the form of a Print Release, and violators of this Law will be subject to its civil and criminal penalties. Client will receive High Resolution photos via a online gallery with print release for personal use only. (For corporate clients, please note that you will receive limited commercial rights to use the images for promotional purposes, as specified in your session package). Digital download includes images for printing and may be used on the web, Facebook, or email by client only. Submission to print media such as newspaper, competition and magazine needs prior written permission from the photographer.
14. REGARDING EXTRA DIGITAL IMAGES: Client may purchase EXTRA digital imges at the rate of Rs200 per digital image for personal portraits sessions. Digital images purchased will be edited and delivered either via web-based digital download, email or custom USB drive. At Nauseen Taher Photography, I do not provide RAW or unedited images. When booking my services, you are choosing me for my unique artistic style and vision, as showcased in my portfolio. All final images are delivered professionally edited in the signature style that defines my work. The editing process is a vital part of my craft,developed through years of training and
experience, and ensures the quality and artistry, you see in my photography. By booking, you agree to trust this creative process.
15. LOSS AND DAMAGES: If the Client looses or damages his or her digital images, Nauseen Taher Photography will not by liable for such loss or damage and will not replace lost or damaged files. It it highly recommended, by the Photographer, that clients immediately back-up any digital files on an external drive or via online cloud storage. Digital images purchased by the Client still remain the property of Nauseen Taher Photography and may not be altered in any way, shape of form, including but not limited to editing the overall style of image, color/contrast/exposure changes, cropping portions of the images, adding objects/persons/graphics and deleting objects/persons/graphics. Digital images purchased by the client may not be shared with other persons and may not be resold. Violators of this Law will be subject to its civil and criminal penalties.
16. REGARDING VIEWING & PRINTING IMAGES: Please note that all images produced by Nauseen Taher Photography have been done so with the use of color callibrated monitors. Monitors used by the Photographer have been callibrated to meet printing standards, thus color changes may occur when images are viewed on non-callibrated monitors. Also note that images viewed in non-professional editing programs will appear less sharp than if the same images are viewed using a professional program. Printed images will be correct in color, sharpness and other variables that may be affected by non-callibrated monitor and non-professional programs, that is, if the printed images have been produced by a professional imaging lab. In order for printed images to meet the quality of the original digital files, they must be printed on high-quality photographic paper or on other professional photographic mediums, and done so by a professional lab. It is highly recommended that the Client order printed images from a reputable, professional lab to ensure that the quality of his or her digital images is met. Nauseen Taher Photography is not liable for the quality of images printed by any imaging lab, both professional and non.
17. Hair and Makeup: To achieve the optimal results showcased on the website, It is highly recomended to secure the services of a professional makeup artist. The makeup artist you choose will be fully responsible for the application and quality of your makeup. Please ensure that you review your makeup and make any necessary adjustments before the makeup artist leaves, as it will be difficult to rectify any issues later during editing. Please note that I cannot be held responsible for any dissatisfaction or complaints regarding hair and makeup if the services of a makeup artist has not been taken.
18. No camera will be allowed during the session. Please refrain from taking photographs behind the photographer's back during the session. It disturbs the photographer's plus takes away from the wow factor when your final images is delivered.
19. This Contract incorporates the entire understanding of the parties. Any modifications of this Contract must be in writing and signed by both parties.
