1. Application for membership is subject to approval by the management of the club. On approval you will receive an email with the bank details and an invoice for the registration fee.
2. It is agreed that the member and in case of a minor, their parents or legal guardian will behave in accordance with the rules and regulations of the club.
3. By submitting this agreement, the member consents to, and authorises Eagles Sport Club to furnish information concerning the payment patterns to any registered credit bureau or to any credit or service provider. The member accepts that this contract will be valid whether classes are attended or not. No credit can be given for classes not attended.
4. Monthly fees are payable in advance on or before the first day of the month, regardless of the time on which the statement is received.
5. The minimum period of this agreement is 3 months, after which the agreement may be cancelled, via email, with a a months' notice (to be given before the 4th of the month).
6. Should the member fail or choose not to give notice, or if there are outstanding fees, then the agreement will continue as per the same terms and conditions of this agreement;
7. Should any payment of the agreed fees not be received in time then the club reserves the right to terminate the agreement with immediate effect and to take legal action, if necessary, against the member in order to secure payment;
8. In the case that legal action needs to be taken, that the member will be held liable for all the fees due in terms of this agreement, as well as the legal costs incurred for collection;
9. The residential and email address as specified herein will be the agreed domicilium citandi et executandi address of the member and it is the responsibility of the member to inform the club and its management of any change of the aforementioned details in writing;
10. The member (and parent) acknowledges and agrees, unless otherwise instructed in writing, that photographs and videos may be taken of them during their participation in club activities. Eagles Sport is granted the right to use these (in print and digital format) for training analysis, promotional materials, marketing purposes, and on social media platforms.
11. Although we take steps to secure the safety of our members by signing this agreement the member accepts the following:
Assumption of Risks:
I understand that the physical activities of Karate, by its very nature, include certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I understand and appreciate the risks that are inherent in the clubs' programs and activities. I hereby assert that my participation is voluntary, and that I knowingly assume all such risks.
Hold Harmless, Indemnity, and Release:
In consideration of permission for my participation, I agree, for myself, my heirs, personal representatives or assigns, to defend, hold harmless, indemnify and release, the EAGLES SPORT CC, its officers, employees, agents, from and against any and all claims, demands, actions, or causes of action of any sort on account of damage to personal property, or personal injury which may result from my participation in the above-listed activity. I understand that by agreeing to this clause I am releasing claims and giving up substantial rights, including my right to sue.
No alteration or relaxation or indulgence to any of the terms of this agreement will be of any force or effect, unless it has been reduced to writing and has been signed by both parties to this agreement.
